Tax Implications for PMs

The 183-Day Rule

If you stay under 183 days per calendar year in Mexico:

• You remain a tax non-resident
• Mexico does NOT tax your foreign-source income (your US salary)
• No SAT registration required

If you stay 183 days or more:

• You become a Mexican tax resident
• You owe Mexican income tax on worldwide income (progressive 1.92% to 35%)
• You must register with SAT and obtain an RFC (taxpayer ID)
• Tax treaties with the US, Canada, UK, and most EU countries prevent double taxation, but you still file in both countries

US Citizens

US tax applies regardless of where you live. The FEIE (~$126,500 in 2024) can exclude foreign-earned income if you qualify (Physical Presence Test or Bona Fide Residence Test). For Mexico-based US PMs, the Physical Presence Test is straightforward to pass once you’ve been outside the US 330+ days.

Equity/RSU complication: if you receive RSUs while in Mexico, vesting events trigger Mexican tax once you’re a Mexican resident. The interaction between US source income rules, Mexican tax residency, and the US-Mexico tax treaty for equity is nontrivial. Get cross-border tax advice before exercising or accepting RSUs as a Mexican tax resident.
